1. Definitions
In these Terms and Conditions:
- "Platform" refers to the Beautify website, application, and booking services operated under the executive leadership of co-founders Parth Jain and Manjiri Sakore.
- "User" refers to any individual accessing or registering on the Platform, including Customers and Professionals.
- "Customer" refers to a User booking beauty, grooming, or wellness services via the Platform.
- "Professional" or "Beautician" refers to independent service providers offering beauty services to Customers via the Platform.
- "Booking" refers to a scheduled appointment for beauty services arranged between a Customer and a Professional.
2. Marketplace Platform Role
Beautify operates as an online marketplace matching platform connecting Customers with independent Professionals. Beautify itself does not employ Professionals, nor does it provide beauty services directly. All contracts for beauty services are concluded directly between the Customer and the Professional. Beautify acts solely as an intermediary facilitating booking coordination, payment processing, and customer support.
3. User Eligibility
To register an account or use our Platform, you must be a resident of India (or reside in a jurisdiction where the Platform is legally available) and be at least 18 years of age. By registering, you warrant that you have the legal capacity to enter into binding contracts under Indian law.
4. Account Registration
Users must register an account to access core booking services. You agree to provide accurate, complete, and updated information (including name, email, phone number, and operating location). You are solely responsible for maintaining the confidentiality of your credentials. Any unauthorized access to your account must be reported to support immediately.
5. User Responsibilities
Customers using the Platform agree to:
- Provide a safe, clean, and cooperative environment for home-based beauty services.
- Provide accurate details regarding service requests, location, and medical/skin sensitivities.
- Make payments on time and respect the Professional's schedule.
- Refrain from attempting to bypass the Platform by soliciting or paying Professionals directly outside of Beautify.
6. Professional Responsibilities
Professionals registering on the Platform agree to:
- Provide services with the highest professional standards, hygiene, safety, and courtesy.
- Possess all necessary qualifications, licenses, insurances, and government clearances required to perform their services in India.
- Fulfill scheduled Bookings or arrange rescheduling in accordance with the Platform's terms.
- Pay the agreed platform commissions or service fees.
7. Verification Process Disclaimer
While Beautify conducts screening and identity verification processes on independent Professionals (such as checking certificates and government IDs), we do not guarantee the qualifications, quality of work, safety, behavior, or legality of the Professionals. The verification process is a filtering screen, and Customers are advised to exercise reasonable caution and review professional bios and ratings.
8. Booking Process
Bookings are requested by Customers and confirmed by the selected Professional. A Booking is legally binding once the Professional accepts the request and payment or booking confirmation is processed. Booking schedules, timelines, and execution are subject to terms set out in our Refund & Cancellation Policy.
9. Pricing and Payments
Service prices are set by the Professionals or configured under standard Platform catalogs and are displayed prior to booking. Customers agree to pay the total booking fees, taxes, and applicable platform service fees. Payments must be processed through our integrated payment systems. Cancellation charges or refund processes are strictly governed by our Refund & Cancellation Policy.
10. Refund Policy
Refunds for cancelled bookings, duplicate payments, or service failures are handled based on eligibility checks. Please refer to our Refund & Cancellation Policy for detailed eligibility criteria, timelines, and dispute instructions.
11. Cancellation Policy
Both Customers and Professionals must adhere to scheduled booking commitments. Rules regarding cancellation time windows, late cancellations, no-shows, and professional rescheduling defaults are detailed in our dedicated Refund & Cancellation Policy.
12. Platform Fees
Beautify reserves the right to charge Customers and/or Professionals platform convenience fees, service fees, or commission splits to maintain platform operations, technology development, and customer support. These fees are generally non-refundable unless specified otherwise in the Refund Policy.
13. Prohibited Activities
Users may not:
- Bypass the Platform to arrange bookings directly, with the intent to avoid platform commissions or terms.
- Post fraudulent reviews, false ratings, or harassing content.
- Register duplicate accounts or use fictitious identity details.
- Reverse engineer or scrape data from the Platform.
14. Intellectual Property
All proprietary software, layouts, designs, copy, graphics, logos, and branding on the Beautify website and application are owned by Beautify and protected by intellectual property laws of India. You may not copy, reuse, or redistribute any assets without prior written consent.
15. Reviews and Content
Users may post reviews, ratings, and portfolio items. By posting, you grant Beautify a non-exclusive, worldwide, royalty-free, perpetual license to host, display, and share this content. We reserve the right to remove any reviews containing offensive language, personal contact details, or false claims.
16. Suspension and Termination
We reserve the right to suspend, freeze, or terminate your account at our sole discretion, without prior notice, if you breach these Terms, violate local laws, fail background checks, receive consistently low ratings, or engage in suspicious activity.
17. Third-Party Services
The Platform incorporates third-party APIs, maps, hosting services, and payment gateways. We are not responsible for the performance, terms, or policies of these independent providers.
18. Limitation of Liability
To the maximum extent permitted by applicable Indian law, Beautify, its co-founders Parth Jain and Manjiri Sakore, directors, and employees, shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability for any claim arising from or relating to your use of the Platform is limited to the platform convenience fees paid by you to Beautify in the three (3) months preceding the incident.
19. Indemnification
You agree to indemnify and hold harmless Beautify, its founders, and affiliates from and against any claims, losses, costs, liabilities, and legal fees arising out of your violation of these Terms, misuse of the Platform, or breach of any third-party contracts or rights.
20. Disclaimer of Warranties
The Platform and its match services are provided "as is" and "as available". We disclaim all representations and warranties, express or implied, including but not limited to the quality, safety, suitability, or promptness of the independent beauty professionals.
21. Service Availability Disclaimer
While we strive to maintain high uptime, we do not warrant that the Platform will be uninterrupted, error-free, or secure at all times. Periodic downtime may occur for upgrades, backups, or circumstances beyond our control.
22. Dispute Resolution
If a dispute arises between a User and Beautify, the parties will first attempt to resolve it through amicable discussions. If unresolved, the dispute shall be referred to binding arbitration in accordance with India's Arbitration and Conciliation Act, 1996, with the place of arbitration being Pune/Mumbai, India.
23. Governing Law
These Terms and Conditions shall be governed by, interpreted, and construed in accordance with the laws of India, without reference to conflict of laws principles.
24. Jurisdiction
Subject to Section 22 (Dispute Resolution), the courts located in Pune or Mumbai, Maharashtra, India, shall have exclusive jurisdiction over all matters and disputes arising out of these Terms.
25. Force Majeure
Beautify shall not be held liable or responsible for defaults or delays caused by circumstances beyond our reasonable control, including natural disasters, acts of god, labor disputes, pandemic restrictions, government regulations, internet outages, or power failures.
26. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted to this page with the update date modified. Your continued use of the platform constitutes binding acceptance of the updated Terms. For data privacy practices, please read our Privacy Policy.
